Summit One Terms of Service
Effective Date: August 07, 2025
1. Introduction
Welcome to Summit One (we, us, our, or Summit One), a cloud-based enterprise software platform designed to automate back-office functions for blue-collar industries, including construction, plumbing, electrical, and paving. These Terms of Service (Terms) govern your access to and use of our websites, mobile and desktop applications, smart watch integrations, APIs, and related services (collectively, the Services). By accessing or using the Services, you (you, User, or Customer) agree to be bound by these Terms, our Privacy Policy, and any additional terms referenced herein.
If you are using the Services on behalf of a business or organization (e.g., as an Account Owner for a blue-collar company), you represent that you have authority to bind that entity, and you refers to both you and the entity. If you do not agree to these Terms, you must not use the Services. Users must be at least 18 years old or the age of majority in their jurisdiction.
2. Definitions
- Account Owner: Manages a Summit One account and End Users.
- End User: Authorized individuals using the Services.
- Services: Platform features for business automation and integration.
- Content: Data uploaded/generated (e.g., photos, records).
- Third-Party Services: Integrated tools (e.g., Stripe, Google Maps).
3. Access and Use of the Services
3.1 Eligibility
You must comply with these Terms and laws to use the Services.
3.2 Account Registration
Provide accurate info and maintain account security. Report breaches to support@summitone.com.
3.3 License
Non-exclusive, revocable license to use Services for business. End Users are covered under Account Owners license.
3.4 Acceptable Use
- No illegal or unauthorized use.
- No malware, reverse-engineering, or data abuse.
- No sensitive data without consent.
3.5 User Roles
RBAC and RLS are used to manage access and permissions.
4. Subscription and Payment
4.1 Plans
Free and paid plans available. Contact sales@summitone.com for pricing.
4.2 Billing
Processed via Stripe. Charges are recurring and non-refundable (unless legally required).
4.3 Taxes
Youre responsible for taxes unless exempt.
4.4 Suspension
We may suspend accounts for non-payment after notice.
5. Content and Data
- You own your Content; we use it to deliver Services.
- Youre responsible for legality and consent for Content.
- DPA available at privacy@summitone.com.
- Data is retained per Privacy Policy and legal requirements.
6. Third-Party Services
Use of third-party integrations is subject to their terms. Extra costs/limits may apply.
7. Intellectual Property
Summit One owns all platform IP. Feedback may be used freely.
8. Privacy and Security
Governed by our Privacy Policy. Includes RBAC, RLS, encryption, and compliance with GDPR/CCPA.
9. Service Availability and Support
- 99.9% uptime target (excludes maintenance, force majeure).
- Support available by email or in-app based on your plan.
- Services are updated regularly.
10. Termination
- You can terminate any time (no refunds).
- We may terminate for violations or inactivity.
- Post-termination, you must stop access and may export Content.
11. Disclaimers and Limitations
- Services provided as is; no guarantees.
- Not liable for indirect damages. Liability capped at fees paid.
12. Indemnification
You agree to hold us harmless from claims tied to misuse, Content, or user disputes.
13. Governing Law
California law governs. Disputes resolved via arbitration in San Francisco, except small claims. No class actions.
14. Changes to Terms
We may update Terms with notice. Continued use means acceptance.
15. Miscellaneous
- These Terms plus referenced policies are the full agreement.
- If any clause is invalid, the rest remain enforceable.
- Failure to enforce isnt a waiver.
- You cant assign Terms; we can during business changes.
- Not liable for delays due to uncontrollable events.
